2. Description of Services

MedLeanRX is an online, physician-guided weight loss platform that connects patients with licensed healthcare providers for evaluation, treatment planning, and, when clinically appropriate, prescription of GLP-1 and other weight management medications. Our Services include but are not limited to: online clinical intake assessments, physician review and consultation, prescription management, medication delivery coordination, and ongoing patient support.

3. Eligibility

You must be at least 18 years of age to use our Services. By using MedLeanRX, you represent and warrant that you are at least 18 years old, are legally capable of entering into binding agreements, and are a resident of a state where our Services are available. MedLeanRX Services are not available in all 50 states. Availability may vary based on state regulations and licensing requirements.

4. Medical Disclaimer

MedLeanRX facilitates access to licensed healthcare providers but does not itself provide medical advice, diagnoses, or treatment. All medical decisions, including the prescribing of medication, are made solely by licensed physicians or other qualified healthcare professionals. The information provided on our website is for general informational purposes only and should not be considered a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition.

5. Compounded Medications

If your clinician determines that compounded medications are clinically appropriate for you, please be aware that compounded medications are not approved by the FDA and have not been reviewed for quality, safety, or efficacy. Novo Nordisk, Inc. is the only United States company with FDA-approved products containing semaglutide, identified under the trade names Rybelsus®, Ozempic®, and Wegovy®. Lilly USA LLC is the only United States company with FDA-approved products containing tirzepatide, identified under the trade names Zepbound® and Mounjaro®.

6. Account Registration & Accuracy of Information

To use certain features of our Services, you may be required to complete an intake assessment and provide personal and health information. You agree to provide accurate, current, and complete information during the registration and intake process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify MedLeanRX immediately of any unauthorized use of your account.

7. Payment & Refund Policy

By purchasing a treatment plan or medication through MedLeanRX, you agree to pay all applicable fees as described at the time of purchase. All fees are due at the time of service. Refund eligibility may vary depending on the stage of your treatment process. If a physician determines that you are not a candidate for treatment after completing your intake and payment, you may be eligible for a refund. Please contact our support team for specific refund inquiries. MedLeanRX reserves the right to change pricing at any time.

8. Medication Delivery

Not all medications are available for home delivery. Availability of home delivery will depend on your insurance or cash pay status, state regulations, and the specific medication prescribed. MedLeanRX is not responsible for delays caused by shipping carriers or circumstances beyond our control. You are responsible for ensuring that someone is available to receive temperature-sensitive medications upon delivery.

9. Privacy & Data Protection

Your privacy is important to us. MedLeanRX collects, uses, and protects your personal and health information in accordance with applicable federal and state laws, including HIPAA (Health Insurance Portability and Accountability Act). By using our Services, you consent to the collection and use of your information as described in our Privacy Policy. We implement reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, use, or disclosure.

10. Prohibited Conduct

You agree not to:

• Provide false, misleading, or inaccurate information during the intake or registration process
• Use the Services for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to any portion of the Services or any systems or networks connected to the Services
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without express written permission from MedLeanRX
• Use the Services to transmit any harmful, threatening, abusive, or otherwise objectionable content
• Interfere with or disrupt the integrity or performance of the Services

11. Intellectual Property

All content, trademarks, logos, and intellectual property displayed on the MedLeanRX website are the property of MedLeanRX or its licensors and are protected by applicable intellectual property laws. You may not use, reproduce, modify, or distribute any content from the Services without prior written consent from MedLeanRX.

12. Limitation of Liability

To the fullest extent permitted by applicable law, MedLeanRX and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, arising out of or in connection with your use of or inability to use the Services. MedLeanRX's total liability to you for any claims arising from or related to the Services shall not exceed the amount you paid to MedLeanRX in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless MedLeanRX, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

MedLeanRX reserves the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Harris County, Texas.
